Repairs and habitability

Heat, water, sewage, mold, pests and structural hazards; what Virginia requires, and the documentation that carries a case.

Awaiting attorney review

This playbook is written and sourced, but a qualified Virginia reviewer has not signed off on it yet. Use it to understand the landscape and to prepare, not as a legal conclusion, a deadline, or a remedy.

Your landlord must keep the home fit to live in and keep promised essential services running. Virginia has a court process for conditions that are ignored, but it has strict requirements, and withholding rent outside that process can put your tenancy at risk.

What the law says

  • Virginia requires a landlord to keep the rental fit to live in and to keep promised essential services working. The statute defines "essential service" to include heat, running water, hot water, electricity and gas (Va. Code § 55.1-1200).
  • If a serious condition is not corrected, Virginia law provides a court process, often called a tenant's assertion or rent escrow, where a judge can order repairs, order rent paid into an escrow account, or abate rent (Va. Code § 55.1-1244).
  • That process has conditions. The statute requires prior written notice to the landlord and payment of rent into the court, and it separates the escrow route from other remedies. It is not a do-it-yourself shortcut.
  • Two versions of § 55.1-1244 are published, one effective until January 1, 2027 and one effective January 1, 2027, so the version that applies depends on the date that matters in your case.

Steps tenants usually take

  1. 01Write out a dated timeline: when the problem started, every report you made, and what happened after each one.
  2. 02Report the condition to your landlord in writing and keep proof of when and how it was delivered.
  3. 03Ask the city to inspect if the condition is unsafe or has been ignored.
  4. 04Ask legal aid whether the court process for repairs or rent escrow fits your situation before you file anything.
  5. 05If neighbors have the same problem, document it across units; a pattern is stronger than a single complaint.

Do not skip these

  • Do not stop paying rent or withhold rent to force a repair. Virginia's rent escrow process runs through a court and requires paying rent into court. Withholding rent on your own can be used against you in an eviction case.
  • Notice content, delivery method and time periods matter, and they changed in 2026. Confirm the current requirements with a lawyer or legal aid before you send anything you are relying on.
